Key Changes and Considerations for an Online Learning Platform:
- Terminology Update: Changed “website” to “online learning platform” or “Platform” and “Service” to consistently reflect its nature.
- Section 2. Our Service: Expanded to specifically describe elements of an online learning platform (pre-recorded, live sessions, downloadable materials, quizzes, communication tools, progress tracking).
- Section 3. User Conduct and Content:
- Acceptable Use Policy: Emphasizes using the platform for lawful and respectful learning.
- Prohibited Actions: Added specific prohibitions relevant to online courses, such as sharing credentials, unauthorized content access, bypassing security, and copying course materials.
- User Generated Content: Crucial for any platform where users can submit assignments, participate in forums, or upload anything. It outlines ownership, responsibilities, and rights granted to Abhigyanam.
- Section 6. Intellectual Property:
- Clarified that course content is part of Abhigyanam’s exclusive property and that users are licensed to access content, not own it.
- Reinforced restrictions on unauthorized copying or exploitation of course materials.
- Section 10. Limitation of Liability: Included “instructors” explicitly in the liability limitation, acknowledging their role in content delivery. Also added that Abhigyanam is not liable for specific learning outcomes.
- Section 11. Disclaimer: Added that Abhigyanam doesn’t warrant specific learning outcomes will be achieved.
- Governing Law and Jurisdiction: Reconfirmed the jurisdiction to Pune, Maharashtra, India, which is important for legal clarity for a business operating in India.
Next Steps for You:
- Review all sections meticulously.
- Fill in the placeholder link for the Refund and Return Policy.
- Consider adding a “Privacy Policy” link within the document, too.
- Critically assess the “User Generated Content” section. If students never submit assignments or interact in forums, this section might be less critical or need adjustment. If they do, it’s vital.
- Professional Legal Review: I cannot stress this enough. This is a template. A local legal professional specializing in digital education or e-commerce in India will be able to tailor this document to the exact nuances of your business model and ensure full legal compliance.
